Shaw Communications Inc. in a lengthy trial before the Competition Tribunal concerning the company’s contested $26 billion merger with Rogers Communications Inc.;
Envergent Technologies LLC, a subsidiary of Honeywell International Inc. and UOP LLC, in four proceedings arising out of the construction and equipping of a biofuel production plant in the city of Port-Cartier, Québec;
SK hynix Inc. and SK hynix America Inc. in class action proceedings alleging price fixing of dynamic access random memory in the Québec Superior Court and the Federal Court, including defeating certification in both jurisdictions;
the Estate Trustees of Barry and Honey Sherman in proceedings against the Toronto Star involving a request to unseal court files concerning the Shermans’ Estates, leading to a precedent-setting decision by the Supreme Court of Canada creating new and important law concerning privacy and court openness; and
Cominar REIT, one of Canada’s largest diversified real estate investment trusts and the largest commercial property owner in Québec, in its C$5.7-billion sale to Iris Acquisition II LP, including securing court approval for a plan of arrangement pursuant to the Canada Business Corporation Act, which raised complex questions on the extent to which the arrangement provisions contained in the Act can be used to arrange a trust governed under Québec law.
