Charles Tingley Hosts Counterfactual Podcast Discussing the Competition Tribunal’s Recent Cineplex Decision

Davies partner Charles Tingley hosts the latest episode of the CBA’s Counterfactual podcast, focusing on the recent decision of the Canadian Competition Tribunal in the Cineplex case. Davies issued a bulletin on this decision last year.

This episode of Counterfactual features Charles in conversation with Competition Bureau counsel Irene Cybulsky, lawyer Michael Osborne and consumer behavior expert Professor Alix Barasch about the case, its legal implications and the relevant compliance considerations for online marketers.

The Cineplex case is the first litigated proceeding involving allegations of deceptive or misleading “drip-pricing” and resulted in a Tribunal order to pay $38.9 million in monetary penalties. This episode continues the discussion among panelists from a Canadian Bar Association Marketing Practices Committee brown bag session held on December 10th 2024 entitled “Straight from the Box Office: Perspectives on the Cineplex Decision.”
