Davies Defeats Certification of Proposed Canned Tuna Price Fixing Class Action Before the Court of Appeal for Ontario

Davies acted for StarKist Co. and Dongwon Industries Co., Ltd. in connection with proposed class action proceedings commenced in Ontario alleging anti-competitive price fixing in the market for canned tuna. In 2023, Davies and the co-defendants’ counsel successfully defeated certification in the Ontario Superior Court. On August 9, 2024, the Court of Appeal for Ontario dismissed the plaintiff’s appeal.
