Davies’ Annual Corporate/Securities Law Moot 2022
On April 1 and 2, students from 12 law schools across Canada competed virtually in the 31st annual Davies Corporate/Securities Law Moot.
This year’s problem, loosely based on the Alberta Court of Appeal’s decision in Calfrac, explored the use of plan of arrangement provisions under the Canada Business Corporations Act in connection with a recapitalization transaction designed to reduce the subject company's outstanding indebtedness and improve its liquidity.
The two top teams competed in a final round before a five-member panel comprising The Honourable Justice Mahmud Jamal of the Supreme Court of Canada; The Honourable Justice Jessica Kimmel of the Ontario Superior Court of Justice; The Honourable Justice Siobhan Monaghan of the Federal Court of Appeal; Mr. D. Grant Vingoe, Chair & CEO of the Ontario Securities Commission; and The Honourable Justice Benjamin Zarnett of the Ontario Court of Appeal.
