Jean-Philippe Groleau Speaks to La Presse on Tracing Individuals with COVID-19

With Ottawa and some provincial governments considering a national strategy to track Canadians infected with COVID-19 using geolocation technology, La Presse featured Jean-Philippe Groleau for his insights on the legal and constitutional questions that such a strategy might raise.

In the article (available in French), Jean-Philippe explained that a pan-Canadian technological solution could take two forms: the provinces and territories could ask the federal government to develop a national solution, or they could adopt a coordinated approach at the provincial level. Next, he added, the measures would need to undergo a constitutional analysis to ensure they respect Canadians’ rights under the Canadian Charter of Rights and Freedoms.

“Are Canadians and Quebecers ready to temporarily give up a certain amount of privacy in order to regain freedom of movement? That is the big question,” he said.
