Léon Moubayed Talks to Canadian Lawyer InHouse About the Growing Threat of White-Collar Crime
In an article published this week in Canadian Lawyer InHouse, Davies partner Léon Moubayed gives his expert take on the growing prevalence of white collar crime amid the COVID-19 pandemic and on the steps that in-house counsel can take to protect their businesses.
Léon points out that, while-high profile cases such as SNC-Lavalin are unusual, business crime on a smaller scale will always be a rampant problem.
“The history of white-collar crime shows that, in every situation – whether you have a booming economy or a financial crisis – white-collar crime will always find its way,” he says. “With the pandemic, you’re going to see vulnerabilities being extorted more and more, and the role of in-house counsel is to make sure you have proper systems in place to detect, prevent and remediate those problems.”
Léon advises in-house counsel to work toward bringing a cultural shift within a company to make corruption socially unacceptable. Outlining rules on the company website is not enough. He believes that such a shift requires real, frank and frequent conversations involving all stakeholders to create a clear commitment against financial crime and to ensure that everyone understands why it is so important.
