Davies Cases and Litigators Recognized in Lexpert Special Edition

Davies Acts in Four of Lexpert’s Top 10 Cases and Has 19 Litigators Named in Guide

We are proud to have advocated for our clients in four of Lexpert’s Top 10 cases in 2019-2020. Lexpert’s annual list identifies the year’s most significant commercial decisions in Canada.

In recognition of the impactful outcomes our litigators have achieved for clients in the past year, we are also pleased that the Lexpert Special Edition: Litigation has named 19 of our partners among the best practitioners in the country.

Advocating for clients in their complex, high-stakes disputes, our talented team of litigators acted in these Lexpert Top 10 cases before the Supreme Court of Canada in 2019-2020:

  • 9354-9178 Québec Inc. (formerly Bluberi Gaming Technologies Inc.) in 9354-9186 Québec Inc. v Callidus Capital Corp., a landmark decision regarding litigation funding and the parties’ required behaviour in insolvency matters;
  • the Canadian Chamber of Commerce as an intervener in Pioneer Corp. v Neil Godfrey, a price-fixing class action in which the Court ruled that so-called umbrella purchasers may have a claim under the Competition Act;
  • the Canadian Chamber of Commerce as intervener in Uber Technologies Inc. v Heller, in which the Court held that a mandatory arbitration clause in the agreement between ride-hailing service Uber and its contracted drivers was unconscionable and therefore unenforceable; and
  • the Mining Association of Canada as an intervener in Canada Nevsun Resources Ltd. v Araya, in which the Court found that corporations can be held liable in civil law for breaches of international law — and that the act of state doctrine is not a bar to the claim.

The firm also received an honourable mention for our work representing West Face Capital Inc. in The Catalyst Capital Group Inc. v VimpelCom Ltd., in which West Face defended successfully, at first instance and on appeal, a $1.3-billion claim arising from its acquisition of WIND Mobile in September 2014.
