David Stolow is a partner in the Litigation practice. He practises corporate/commercial and civil litigation. He has represented clients in a wide range of areas, including class action defense, defamation suits, shareholder litigation, various forms of commercial and contractual disputes, construction and real estate matters, and employment-related disputes. David has appeared as counsel before the Supreme Court of Canada, all levels of courts in Québec, as well as in international and domestic arbitrations.
In 1998-1999, David articled with Justice Nicole Morneau of the Québec Superior Court.
Representative Work
- Counsel for the respondents before the Supreme Court of Canada in the case of Bou Malhab v. Diffusion Métromédia CMR Montréal Inc. et al. v., a defamation class action brought by a group of taxi drivers in Montréal.
- Represented The Globe & Mail before the Supreme Court of Canada in an appeal involving the right to freedom of the press and publication bans against the media.
- Defended a leading generic drug manufacturer before the Québec Court of Appeal and the Québec Superior Court against the authorization of a $3.9 billion class action brought on behalf of all Québec residents in the "Piro" case, one of the largest proposed class actions in Québec history.
- Acted, pro bono, as co-counsel for the appellant in the landmark case of Bruker v. Marcovitz, where the Supreme Court of Canada allowed the appellant's appeal and upheld an award of damages for the breach of a promise to provide a Jewish divorce.
Articles And Publications
David is the author of "Defending class in Quebec: The right to an ‘undoubtedly, real, vigorous and unconstrained’ contestation?" (Corporate Liability, July 2006) and he has authored numerous news articles issued by the firm in the area of class actions.
Speaking Engagements
David has lectured on class actions in Québec and in France. He has also provided seminars to clients with respect to drafting arbitration clauses.
