Harry Heching is a partner in the commercial real estate group specializing in all aspects of real estate law.  He represents private and institutional investors and developers in the financing, sale, acquisition and joint venturing of real property throughout the United States.

Harry has represented pension funds, commercial mortgage lenders and borrowers nationally in real estate financing programs covering office properties, retail centers, senior and assisted living facilities, multi-family buildings and hotels.  This has included off-balance sheet and real estate-related financings such as sale-leasebacks and mezzanine loans.  As the size and complexity of real estate projects have grown, his practice has increasingly involved negotiating various types of joint ventures, primarily limited liability companies, REITs and S corporations. He has represented both the institutional/finance parties to these ventures as well as the developer/sponsor entities.  

Harry has extensive national commercial leasing experience from both the landlord and tenant perspective in office building, retail and shopping center lease negotiations, having negotiated leases covering all types of properties, including both offices and retail, and has represented clients in net lease, ground lease and sublease negotiations. In particular, Harry does national commercial leasing work for a well-known national law firm.  He has also negotiated lease assignments and worked with clients in lease work-outs and leasehold mortgage financing.  Harry is an expert in title practice and title insurance coverage and has handled sales and purchases of properties in many of the fifty states. In construction, he has extensive experience in negotiating general contract, construction management, design-build and architects' agreements for construction projects of all types, representing, in most instances, developer/owners.  

Harry has represented various banks and borrowers in all aspects of construction loans; has been involved in the purchase and sale portfolios of real estate assets (including both real properties and real estate mortgage loans) by sealed bid auctions and individual negotiated transactions; and has been active in all aspects of regional shopping center development and construction practice.  He has worked with banks and other financial institutions, governmental agencies and developer/owners in structuring workouts of troubled projects and properties.  

Harry is a member of the Real Property Law Section of the New York State and American Bar Association. He is the author of "Attorney Liability to Third Parties for Negligent Misrepresentation in an Opinion Letter", Real Estate Finance, Summer, 1991; "Reforming Foreclosures: 19th Century Rules Don't Work in a 21st Century Environment", New York Law Journal, October 19, 1994; and "Real Property Foreclosure Actions and Deficiency Judgements: a Call for Reform", Real Estate Finance Journal (Warren Gorham & Lamont Inc.) Spring 1995.  

Harry received his B.S. (magna cum laude) and B.Arch. from City College of the University of New York in 1973, and his M.U.P. in Urban Planning in 1977 and J.D. in 1978 from New York University.
