Distribution & Pricing Practices
 
 
The Competition Act, other federal and provincial legislation in Canada, and the common law, all can restrict distribution and pricing policies in Canada. Members of our Group frequently advise or represent clients with regard to conduct such as:
  • Terminating, refusing or limiting supply to distributors or dealers;
  • Influencing resale or advertised prices by distributors or dealers;
  • Charging different prices to competing customers (price discrimination), including:
    • Terms of sale to buying groups;
    • Aggregation of sales volume among international affiliates;
    • Conditional discounts;
  • Low pricing policies (predatory pricing);
  • Bids and tenders;
  • Tied selling and exclusive dealing policies;
  • Grey marketing;

Our representation can be in the context of responding to investigations or complaints by the Competition Bureau, or defending against proceedings in the ordinary courts or the Competition Tribunal.
