Advertising & Marketing Practices
 
 
Our Group frequently assists clients with matters involving advertising and marketing issues.  We have represented clients in both initiating and responding to inquiries by the Competition Bureau, proceedings by the Attorney General and Advertising Standards Canada proceedings.

We also advise clients on how best to structure advertising and promotional campaigns to ensure compliance with appropriate advertising laws and the Consumer Packaging and Labelling Act and related regulations.  Our Group has also provided advice and guidance on matters involving the multilevel marketing, telemarketing and pyramid selling provisions of the Competition Act.

Much of our work in this area is not a matter of public record, indeed our goal is to keep it that way.  However, the following list describes in general terms the type of matters in which we have been involved:

  • Advising clients on the ordinary sale price provisions under the Competition Act;
  • Advising clients in respect of comparative advertising claims;
  • Reviewing contest rules and regulations;
  • Developing comprehensive advertising compliance programs including seminars and written materials;
  • Representing clients in response to Competition Bureau investigations into their advertising and marketing practices;
  • Negotiating informal undertakings and formal consent agreements to resolve Competition Bureau concerns.
