In particular, the firm has extensive experience in litigating or settling class actions in several fields, including competition, securities, product liability, and various actions relating to regulatory violations. Recently litigated, settled or ongoing cases include:
- Acting for defendants in multiple class actions commenced throughout Canada relating to an alleged conspiracy to fix prices in the market for vitamins in Canada;
- Successfully represented defendants before the Ontario Court of Appeal and the Supreme Court of Canada in a landmark appeal concerning the certification of a class action brought on behalf of indirect purchasers alleging a conspiracy to fix prices;
- Defending a multi-billion dollar class action filed against several generic drug manufacturers for the reimbursement of alleged rebates paid to pharmacists and challenge to new provisions of the Code of Civil Procedure relating to the authorization of class actions on the basis of the Québec Charter of Human Rights and Freedoms (before the Superior Court of Québec);
- Representing defendant in a class action suit relating to product liability associated with alleged side effects to licensed prescription medications;
- Representing the largest independent investment dealer in Canada in relation to multiple securities class actions involving real estate investments in the southern United States;
- Defending multiple class actions instituted against multinational manufacturers across Canada alleging price fixing in the polyester staple industry.
