International Trade Regulation
 
 
Our international trade regulation practice is a multidisciplinary group of lawyers experienced in international law and international business regulation as it relates to cross-border transactions. We advise Canadian and international clients on the impact of international law and Canadian trade regulation on their business transactions and assist them in the strategic use of international law and trade regulation to advance their business objectives. Our practice includes advising on trade agreements such as the WTO and NAFTA; international arbitration and dispute settlement; foreign investment review under the Investment Canada Act; investment treaties; anti-dumping and countervailing duties; customs; import and export controls; anti-bribery and anti-money laundering; and other aspects of international economic regulation.

Members of our group have advised Canadian and foreign governments, international agencies and business organizations in connection with the application of international trade arrangements, treaty negotiations and international economic policy initiatives. Members of our group have been invited to testify and give presentations to Canadian federal and provincial legislative committees, WTO and NAFTA Working Groups, as well as United States and other foreign regulatory agencies on issues relating to international business regulation:

  • Acres International Ltd., in its successful defence before the World Bank's Sanctions Committee with regard to charges under the Bank's anti-corruption policy;
  • Trammell Crow Company, in its claim against the Government of Canada pursuant to the investor protection provisions of NAFTA Chapter 11;
  • Russel Metals Inc., in connection with the Government of Canada's proposed steel safeguard measures;
  • Microsoft Corporation, in CITT procurement proceedings under NAFTA;
  • BMG Canada, in connection with WTO and NAFTA aspects of its dispute with Warner Music regarding licensing practices.
